Abstract

This study discusses the implementation of the distribution of inheritance in Poigar District Bolaang-Mongondow Regency. The formulation of the problem in this thesis is (1) How is the division of inheritance among the people using customs? (2) How is the Islamic law review regarding the distribution of inheritance with customs among the community?. The purpose of this thesis research is (a) to find out the implementation and describe or describe the distribution of inheritance in Poigar III Village Bolaang Mongondow District, (b) to know the review of Islamic Law on the implementation of inheritance distribution in Poigar District Bolaang Mongondow Regency. This type of research is qualitative field research, in which the writer will describe or describe the division of inheritance in Poigar III Village as in the formulation of the problem. In qualitative research methods, the writer uses descriptive research type, which is an analysis that is descriptive of the meaning and data phenomena that can be captured by researchers, by showing the evidence, this research uses a normative approach, which is to measure against Islamic law. The distribution of inheritance among the people is done when the testator dies, or before the testator dies, depending on the situation and conditions. In its distribution, it is carried out by consensus in the family, the distribution is only done or the heir is the child of the testator and the oldest child distributes it, sometimes in the distribution there is involvement of village officials or people entrusted by the family or who have been entrusted by the testator before dying. Customary tradition is the legal basis used in the distribution, this has been going on since the ancestors of the community and is still maintained today. In the parts of heirs are usually divided equally, there is also an exaggeration for reasons of service to the testator before dying such as looking after and caring for the testator before dying if he dies due to illness. Regarding adopted children or stepchildren, they still get a portion depending on the consensus agreement of the family.
